If you were injured in an accident that was caused by another person’s negligent, intentional or reckless conduct, you may seek compensation in a personal injury claim. What is a Negligence Action?

When a person harms another by a negligent act or omission, the injured party may seek compensation. In order to prove negligence, the plaintiff must show that the defendant violated a duty in the following way:

  • A duty must be owed to the plaintiff;
  • The defendant must violate that duty;
  • It must be shown that the plaintiff experienced an injury as a result of the defendant’s actions or non-action; and
  • Finally, it must be shown that the injury was a “reasonably foreseeable consequence” of the defendant’s conduct

Negligence actions generally must be filed within three years in Maryland. There are some exceptions that may apply to your specific case.  Attorney Brown can clear up any confusion about these exceptions. The personal injury lawsuit seeks to obtain compensation for negligent conduct. The compensation may include:

  • Medical and hospital expenses from the time of the accident
  • Lost income and future lost income
  • Pain and suffering
  • Property damage
  • Other damages based on your claim

Ask Attorney Brown about Maryland’s contributory negligence law and whether it will affect your case. A thorough case review is required in order to properly assess your case.
